This STALLION BREEDING CONTRACT FOR _______, is made and entered into on this _____________day of _______________,______, by and between Robin H. Lovings, doing business as PAINTED LOVE FARMS, hereinafter designated Mare Owner, Mare owner agrees to breed:

To APHA STALLION "DUDES JET BAR LEO" for the fee of $450.00, for a live foal guarantee, subject to the following conditions:
1. The stallion fee of $__________, payable upon execution of this contract. All other expenses must be paid when the mare is picked up. Mare owner may not remove the mare from the breeder's possession until ALL expenses are paid in full.
2. Mare owner agrees and he/she fully understands that under no circumstances is the breeder to be held responsible for any injury or death to unfortunate accidents to mare and or foal while in Painted Love Farms possession. Mare owner agrees to pay $6.00dry/$8.00wet, per day for there mare and/or foal while at the breeding barn. None of condition #2 applies if mare is brought daily by owner for breeding.
3. Breeder will exercise judgment consistent with normal standards in care of the mare/and or foal. Breeder assumes responsibility for arranging veterinarian and farrier services as necessary for the health and safety of the mare and/or foal. the mare owner will pay ALL veterinarian and farrier expenses.
4. Mares shall be halter broken, in healthy and sound breeding condition, free from infectious diseases. A current negative coggins test IS required, along with a copy of registration papers (both sides), and vaccination and worming records must accompany mare. Breeder reserves the right to refuse mare if not in satisfactory condition.
5. Mare owner shall pay ALL veterinary expense incurred in connection with the breeding.
6. Breeder agrees to diligently try to settle mare: however, if mare fails to settle, for any reason, mare owner will not hold breeder blameless. Mare owner agrees to give breeder ample time to settle mare.
7. This contract contains a "LIVE FOAL GUARANTEE". That is a newborn foal which stands and nurses without assistance. If foal is born dead or dies after birth due to inability to stand and nurse, there are return privileges for ______ only if breeder is notified within 30 days along with a veterinarian's statement confirming death.
8. A breeder's certificate will be issued for the foal, conceived by this mating if dam is Paint, Quarter Horses or approved outcross when foal is born and stallion fee and all other expenses have been paid in full.
9. Both parties agree that PAINTED LOVE FARMS, their agents or employees are NOT liable for death, sickness and/or accident including damage cause to the mare and/or foal caused by willful and wanton gross negligence of the breeder: and the mare owner is not liable for the death, sickness, and/or accident including damage to the stallion.
10. If the stallion should die, be unfit for service prior to settling the are, the breeding fee will be refunded: IF it has been paid in full, thereby canceling this contract. Or if mare dies or becomes unfit to breed prior to settling the mare, the mare owner may substitute another mare if breeding fee's have been paid in full.
11. The mare owner is responsible for full insurance on the mare and/or foal.
12. This contract is entered into the State of North Carolina, and will be interpreted and enforced under the laws of that state. If any clause in this contract is against North Carolina State Law, then that clause shall be null and void.
13. Should either party breach this contract, the breaching party shall pay for the other's court cost and attorney fees related to such breach.
14. This contract represents the entire agreement between the parties. No other agreements or promises, verbal or implied, are included unless specifically stated in this written contract. Additional conditions should be individually initialed by each party.
When breeder and mare owner sign this contract, it will be binding on both parties, subject to the above terms and conditions.
